This is a translation of the German terms of use. In case of doubt, the German version applies.

1. Scope

These terms of use apply to the mobile app dB Ride (bundle ID: com.dbride.app) and the associated website, operated by eastfreak Studios (Steffen Kilian, Semperstraße 3d, 01069 Dresden, Germany).

By installing or using the app you agree to these terms. If you do not agree, do not use the app.

2. Description of services

dB Ride is an application for measuring sound levels (in decibels) and for GPS-based recording of trips. The app offers the following features:

dB Ride is intended solely for informational measurement and documentation. The readings depend on the quality of the device microphone and do not constitute a calibratable or officially recognised measurement.

3. Rights of use

eastfreak Studios grants you a non-exclusive, non-transferable, revocable right to use the app for personal, non-commercial purposes on your own devices.

4. In-app purchases and Premium

dB Ride offers optional paid features (Premium). Purchases are processed via the respective app store (Google Play Store / Apple App Store) and are subject to that provider's payment terms.

Premium is a one-time purchase, not a subscription. Refunds are governed by the policies of the respective app store provider. We are not authorised to issue refunds directly.

5. Disclaimer

5.1 No warranty for measurement accuracy

The readings displayed by dB Ride are captured via the smartphone's microphone and are not calibrated. They serve as personal guidance and must not be used as the basis for legal, medical, technical or official decisions. eastfreak Studios accepts no liability for damages arising from the use of or reliance on these readings.

5.2 No liability for road safety

Using the app while driving is at your own risk. Operating a smartphone while driving is illegal and dangerous in many countries. eastfreak Studios expressly recommends operating the app only while stationary.

5.3 Availability

The app is provided “as is”. eastfreak Studios gives no guarantee of uninterrupted availability, freedom from errors or fitness for a particular purpose.

The processing of personal data by dB Ride is governed by our privacy policy, which forms part of these terms of use.

8. Intellectual property

All content of the app and this website – including logo, design, texts, graphics and code – is the property of eastfreak Studios and protected by copyright. Any use beyond these terms requires express written permission.

9. Changes to the app and the terms

eastfreak Studios reserves the right to change, extend or discontinue the app at any time and to amend these terms of use. Users will be informed of material changes where possible. Continued use of the app after a change constitutes acceptance.

10. Termination / suspension

eastfreak Studios reserves the right to block or restrict access to the app without prior notice in the event of violations of these terms of use.

11. Applicable law and place of jurisdiction

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for all disputes arising from or in connection with this agreement is, to the extent permitted by law, Dresden, Germany.

For consumers within the EU, the law of their country of residence takes precedence insofar as it contains mandatory consumer protection provisions.
